Disputes Tribunal Limit Increased to $60,000 – What It Means for Hamilton Disputes

From 24 January 2026, the Disputes Tribunal can now hear claims of up to $60,000, doubling the previous limit of $30,000.

This is an important change for people and businesses in Hamilton & Waikato dealing with disputes — making it easier, faster, and more affordable to resolve disagreements without going to court.

Why This Change Matters

The increased jurisdiction significantly improves access to justice, particularly for individuals and small businesses who may previously have found court action too expensive or complex.

Key benefits include:

  • Lower costs compared to District Court proceedings
  • Faster resolution of disputes
  • A practical, informal process focused on fairness rather than legal technicalities
  • No lawyers at hearings, helping level the playing field

What You Should Do If You Have a Dispute

If you’re considering making or defending a Disputes Tribunal claim:

  • Check your claim is $60,000 or less, and relates to a genuine dispute (and not just a failure to pay)
  • Gather relevant documents, communications, and evidence
  • Attempt to resolve the issue directly before filing
  • Prepare a clear explanation of what happened and what outcome you’re seeking

Good preparation is often the difference between success and frustration.

Legal Advice Before a Disputes Tribunal Hearing

Although lawyers cannot represent you at the hearing itself, getting legal advice beforehand can be invaluable.  We have seen claims fail, because clients were not prepared with suitable evidence, responses, or focused on the wrong things.

At Foley Douglas, our Hamilton lawyers regularly assist clients with disputes by:

  • Assessing whether the Disputes Tribunal is the right forum
  • Helping prepare strong, well-structured claims or responses
  • Reviewing evidence and identifying key issues
  • Advising on settlement options and likely outcomes
